1. Acceptance of Terms

By accessing or using this website, submitting a contact or estimate request, or engaging Horizon City Deck & Fence to perform any work, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and customers of Horizon City Deck & Fence.

2. Description of Services

Horizon City Deck & Fence provides residential deck building, fence installation, and related outdoor construction services in the Horizon City, TX area and surrounding communities. Services include, but are not limited to, custom deck design and build, composite and wood deck installation, fence installation, pergola installation, covered patios, and screened porches.

All services are subject to a written estimate and signed contract before work begins. We reserve the right to decline any project at our discretion.

3. Estimates and Pricing

Free on-site estimates are provided without obligation. An estimate is valid for 30 days from the date it is issued, unless otherwise stated in writing. Estimates are based on the scope of work, materials, and site conditions known at the time of the estimate. Changes to scope, materials, site conditions, or unforeseen circumstances may result in a revised estimate before or during the project.

Prices quoted in an estimate do not include permit fees unless specifically stated. Permit fees are passed through to the customer at cost.

4. Scheduling and Cancellation

Project start dates are scheduled after a contract is signed and any required deposit is received. Scheduling is subject to availability and permit approval timelines, which are outside our control. We will notify you promptly of any scheduling changes caused by weather, permit delays, or other circumstances.

If you need to cancel a project after signing a contract, please notify us in writing as soon as possible. Cancellation terms, including any deposit forfeiture, will be stated in the written contract. Work that has already been completed or materials that have been ordered may be billed at the applicable rate.

We reserve the right to suspend or terminate work if site conditions become unsafe, if access to the work area is not provided as agreed, or if payment obligations are not met.

5. Payment Terms

Payment terms are set out in each written contract. Typically, a deposit is required before work begins, with the balance due upon project completion. We do not require full payment upfront. Acceptable payment methods will be specified in your contract.

Invoices that are not paid within the timeframe stated in the contract may be subject to a late fee. We reserve the right to place a mechanic's lien on the property for unpaid amounts in accordance with Texas law.

All prices are in U.S. dollars. Sales tax will be applied where required by law.

6. Permits and Inspections

For projects requiring a building permit, we will apply for and manage the permit on your behalf unless otherwise agreed in writing. Permit fees are the responsibility of the customer. Permit approval timelines are controlled by the local building department and are not within our control.

Construction will not begin until any required permits are approved. All required inspections will be scheduled and completed before the project is considered finished.

7. Warranty

Warranty terms for labor and workmanship will be stated in the written contract for each project. Manufacturer warranties on materials - such as composite decking boards or vinyl fence components - are separate and subject to the terms of the applicable manufacturer. We will assist you in making a manufacturer warranty claim but are not responsible for the outcome of those claims.

Our warranties do not cover damage caused by improper use, lack of maintenance, extreme weather events, or modifications made by others after project completion.

This website and its content are provided "as is" without warranty of any kind. We make no representations that the information on this website is accurate, complete, or current.

8. Limitation of Liability

To the fullest extent permitted by law, Horizon City Deck & Fence shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website, your reliance on any information provided here, or any services we perform.

Our total liability for any claim arising out of a construction project shall not exceed the total amount paid to us for that project. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Intellectual Property

All content on this website - including text, images, logos, and design - is owned by or licensed to Horizon City Deck & Fence. You may not reproduce, copy, distribute, or use any content from this website for commercial purposes without our prior written permission.

10. Dispute Resolution

If a dispute arises between you and Horizon City Deck & Fence, we encourage you to contact us directly first. Most issues can be resolved through direct communication. Please reach us at sales@horizoncitydeckandfence.com.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any legal action that cannot be resolved through mediation shall be resolved in a court of competent jurisdiction in El Paso County,Texas.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms or your use of our services shall be brought in El Paso County, Texas.

12. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will post the revised Terms on this page with an updated effective date. Your continued use of this website after a change is posted means you accept the updated Terms. We recommend reviewing this page periodically.
